These Terms of Service ("Terms") govern your access to and use of PitStop's website, mobile platform, and related services (collectively, the "Platform"), operated by PitStop ("we", "us", or "our"). Please read these Terms carefully before using the Platform.
1. Acceptance of Terms
By accessing or using PitStop's website, mobile platform, or related services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use PitStop. By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
To place orders, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Orders and Pricing
All orders placed through PitStop are subject to availability and confirmation. Prices displayed on the Platform are subject to change without notice. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors.
5. Payments
Payment for orders must be made through the methods supported on the Platform. By submitting payment information, you represent that you are authorized to use the payment method provided. All transactions are processed securely through our payment partners.
6. Delivery and Pickup
Estimated delivery times are provided for convenience and are not guaranteed. PitStop is not liable for delays caused by third-party couriers, traffic, weather, or other circumstances beyond our reasonable control.
7. Returns and Refunds
Unused parts in their original packaging may be returned within 14 days of delivery, subject to inspection. Refunds will be processed to the original payment method within a reasonable time after the returned item is received and approved.
8. Product Information
We strive to ensure that product descriptions, images, and compatibility information are accurate. However, we do not warrant that all information on the Platform is complete, current, or error-free. Always verify part compatibility before installation.
9. Prohibited Conduct
You agree not to use the Platform for any unlawful purpose, to interfere with the security or proper functioning of the Platform, to submit false or misleading information, or to infringe on the rights of PitStop or any third party.
10. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is the property of PitStop or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
11. Limitation of Liability
To the fullest extent permitted by law, PitStop shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any products purchased through it.
12. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to PitStop, other users, or third parties.
13. Changes to These Terms
We may revise these Terms of Service from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.
